Commercial Lending

Banking litigation expert witness providing objective analysis

Commercial lending involves a wide range of credit products, underwriting methodologies, collateral structures, and ongoing risk management practices designed to support business financing while managing institutional risk. Financial institutions typically rely on established policies, regulatory guidance, and generally accepted banking practices when originating, administering, and monitoring commercial loans.

Disputes in commercial lending matters may center on issues such as underwriting standards, credit approval processes, loan documentation, collateral valuation, covenant monitoring, loan modifications, workout strategies, and institutional oversight. Questions may arise regarding whether lending decisions and servicing activities were consistent with internal policies, regulatory expectations, and commonly accepted industry practices at the time.

As a banking expert witness with extensive executive leadership experience in commercial lending and credit administration, I provide independent analysis of commercial lending operations and institutional practices. This includes review of loan files, underwriting documentation, credit memoranda, collateral evaluations, policies and procedures, servicing records, and decision-making processes throughout the life of a loan.

Engagements may involve evaluation of credit risk management practices, loan approval authority structures, monitoring and reporting controls, workout and restructuring activities, and the governance frameworks used by financial institutions to oversee commercial lending portfolios.

My role is to assist counsel in understanding how commercial lending is typically conducted within financial institutions and whether actions taken align with generally accepted banking practices, regulatory guidance, and institutional standards of care. All opinions are formed independently and are based on industry practices and operational experience rather than legal interpretation.
